TERMS AND CONDITIONS OF USE for nohodl.org

1. Preliminary Provisions and Basic Information

1.1. The website nohodl.org (hereinafter referred to as "NH") is an international, free classifieds service intended for users who accept the sale, purchase, and exchange of goods and services, including for cryptocurrencies and stablecoins.

1.2. When posting an advertisement, the user can choose the price, among others, in:

  • USD $ (US Dollar) – the service automatically converts the value to BTC and other cryptocurrencies and stablecoins available in the converter. Data comes from statistical site APIs, so values may differ from exchange rates.

  • Directly in a selected cryptocurrency available on the service – the service automatically shows the current value of the chosen price in cryptocurrency to USD. The user independently monitors the market rate and updates the advertisement at their discretion.

  • Directly in stablecoins available in the selection options.

1.3. IMPORTANT WARNINGS:

  • NH does not recommend or endorse any cryptocurrencies or stablecoins.

  • Displayed conversion rates are for informational purposes only and represent an approximate market price.

  • Cryptocurrencies and stablecoins on the service do not constitute investment advice.

  • Every user must independently conduct their own research (DYOR) regarding cryptocurrencies/stablecoins appearing on the service and assess their value and risk.

  • NH is not responsible for the value of cryptocurrencies, exchange rate differences, or for any transactions (financial, barter, deliveries, guarantees, escrow).

  • NH does not offer buyer protection or seller certificates.

  • The service is intended primarily for local P2P transactions conducted in person. Any deviations (e.g., shipping) are risky – cryptocurrency transactions are irreversible.

  • Cryptocurrencies are characterized by high volatility, and the crypto market is susceptible to manipulation.

  • The user independently verifies the legality of cryptocurrencies in their country and the tax and legal consequences of transactions (including barter).

1.4. NH reserves the right to add and remove cryptocurrencies and stablecoins from the service and makes efforts to ensure conversion rates are as current as possible.

 

1.5. Geographical Restrictions and List of Supported Countries

1.5.1. The nohodl.org service is available EXCLUSIVELY to users who have their place of residence or registered office in the following countries:

European Economic Area (EEA) Countries:
Austria, Belgium, Bulgaria, Croatia, Cyprus, Czechia, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Iceland, Ireland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Netherlands, Norway, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden

Other Supported Countries: Switzerland

1.5.2. Prohibition of Use from Other Countries: Users from countries NOT LISTED above MAY NOT use the Service. Any attempt to register, log in, or use the Service by such a user constitutes a violation of these Terms.

1.5.3. Responsibility for Data Accuracy: The user declares that they provide their true country of residence/registered office. Providing a false country to circumvent geographical restrictions constitutes a violation of the Terms and may result in immediate account deletion without refund.

1.5.4. Mechanism of Geographical Restrictions:
The registration form provides only the list of supported countries (listed in point 1.5.1). A user from an unsupported country CANNOT select their country and therefore CANNOT register in accordance with the Terms. Any registration attempt by a user from an unsupported country (e.g., by selecting another country) constitutes a violation of these Terms.

1.5.5. Restrictions have been introduced to ensure compliance with EU regulations concerning consumer protection, anti-money laundering, and international sanctions.

 

2. General Rules of Service Use

2.1. NH provides a website, mobile applications, and tools under the domain nohodl.org.

2.2. These Terms of Use govern the rules for using NH's services. Terms differing from these do not apply unless confirmed in writing by NH.

2.3. The Terms are drafted in Polish – the Polish version is binding.

2.4. The service is free for all users.

 

3. Description of Services

3.1. NH enables users to create and publish advertisements (text + images), browse other users' advertisements, and exchange messages between parties.

3.2. NH may convert files to appropriate formats (including for mobile applications).

3.3. NH is not the provider of goods/services offered in the advertisements.

3.4. The service may display additional information about the user (e.g., response rate, activity), enable ratings, comments, following users/advertisements, and notifications.

3.5. NH may promote user advertisements in external media (including translations) and enable the publication of third-party advertisements.

3.6. Customer support: complaints and inquiries at info@nohodl.org.

 

4. User Account

4.1. Full use of services requires registration. Minors may register only with the consent of their legal guardian. Responsibility for the truthfulness of age declaration and obtaining guardian consent lies solely with the user.

4.2. It is possible to post advertisements without registration (email only).

4.3. The user is obliged to provide true data and update it.

4.4. Registration = an offer to conclude a usage agreement; NH confirms it with a verification email.

4.5. The password must be protected; in case of suspected breach – immediate change and notification.

4.6. Limitations: one private account, multiple commercial accounts (for different companies).

4.7. NH may limit features or test new ones for selected groups.

 

5. Conclusion of an Advertisement Publication Agreement

5.1. Submitting an advertisement = an offer to conclude an advertising agreement (temporary publication).

5.2. NH may accept the offer by activating the advertisement; there is no obligation to accept.

5.3. NH may limit the number of free advertisements.

 

6. Requirements Regarding Advertisement Content

6.1. The advertisement must be in the appropriate category, truthful, and complete (including images).

6.2. Content violating the law, the Terms, third-party rights, or good morals is prohibited – in particular, the list of prohibited categories (including pornography, violence, drugs, counterfeits, personal data, illegal goods).

6.3. Commercial users are subject to additional information and tax obligations in their country – NH is not responsible for their fulfillment.

 

7. Special User Obligations

7.1. Prohibition of actions threatening the service, other users, or exceeding the intended use (including spam, viruses, scraping, collecting other users' data).

7.2. Obligation to archive one's own data in case of evidentiary needs.

 

8. Content Removal, User Blocking, and DSA Compliance

8.1. NH may remove in whole or in part advertisements, comments, or other user content, delay their publication, temporarily or permanently block user accounts, if there are indications that the content or user actions violate these Terms, legal requirements, third-party rights, or good morals. NH will inform the user of such a decision and its justification on a permanent medium (email), unless justification is impossible for security or legal reasons.

8.2. Compliance with the Digital Services Act (DSA): nohodl.org operates as a hosting service provider within the meaning of Regulation (EU) 2022/2065 (DSA).

  • Mechanism for reporting illegal content: via the "Report" button or email to info@nohodl.org. Reports are processed within a reasonable time, with justification of the decision for the reporter and the content author (Art. 16 DSA). NH may require additional information or evidence from the reporter.

  • Transparency: moderation decisions are justified and communicated via email.

9. Fees and Additional Services

9.1. Basic use of the nohodl.org service is free.

9.2. The Administrator reserves the right to introduce paid additional features in the future, such as promoting advertisements, marking as featured, or other premium services. Users will be informed about the introduction of such options and their conditions in a separate notice, and these Terms will be updated accordingly. Any eventual payments will be made exclusively through payment channels indicated by NH.

9.3. Acceptance of paid features requires separate user consent.

 

10. Exclusion and Limitation of Administrator's Liability Clause

10.1. NH operates solely as a hosting service provider (classifieds board). NH does not participate in, supervise, or bear responsibility for transactions, negotiations, or agreements between Users. NH is not a party to any agreements concluded between Users and does not bear contractual liability for their performance.

10.2. NH IS NOT LIABLE for:
a) the content, truthfulness, legality, or safety of Advertisements,
b) the identity, credibility, or intentions of Users,
c) the quality, safety, legality of offered goods or services,
d) the performance, non-performance, or manner of performance of agreements between Users,
e) financial losses, loss of profits, data loss, business interruptions,
f) actions of third parties (including technical providers).

10.3. To the maximum extent permitted by law, NH's liability (if established) is limited solely to damages resulting from intentional action.

 

11. Indemnification Clause

11.1. The User undertakes to COMPENSATE ALL DAMAGES (including court, attorney, administrative costs, and compensation) caused to NH in connection with:
a) claims of third parties against NH (of any nature),
b) any judicial, arbitral, or administrative proceedings,
c) the User's violation of the Terms or law.

11.2. The clause also applies after termination of Service use.

 

12. Termination of Agreement

12.1. The User may terminate the agreement at any time (email or account deletion).

12.2. NH may terminate without stating a reason, remove advertisements and data (with legal exceptions).

 

13. Personal Data Protection

13.1. Details in the Privacy Policy.

 

14. Changes to the Terms of Use

14.1. NH reserves the right to introduce changes to these Terms of Use, in particular to adapt to changes in law, service functionality development, or security improvement.

14.2. NH will inform registered users of planned changes at least 15 days in advance, by sending the new version of the Terms of Use to the email associated with the account and publishing it on the service page with a clear indication of the effective date.

14.3. The User has the right not to accept the changes. In such a case, they should terminate the usage agreement (delete the account or send a statement to info@nohodl.org) before the changes take effect.

14.4. Continued use of the service after the effective date of the changes constitutes explicit acceptance of the new version of the Terms of Use.

14.5. In the case of non-substantial changes (e.g., editorial, improving readability) or changes required by absolutely binding legal provisions, changes take effect upon publication without separate notice.

 

15. Final Provisions

15.1. For users who are not consumers, the competent court is the court in Wrocław, Poland. For consumers, the jurisdiction of courts is determined in accordance with absolutely binding EU provisions (including the Brussels I bis Regulation), enabling the consumer to choose the court of their place of residence.

15.2. The Terms and Privacy Policy are binding in the Polish version.

15.3. Local transactions are subject to the law of the place of execution.

15.4. Possibility of out-of-court dispute resolution; interpretation questions at info@nohodl.org.

15.5. Salvatorius clause: The invalidity of individual provisions does not affect the rest; gaps are filled by statutory provisions or party negotiations. In case of invalidity of a provision, the parties undertake to replace it with a provision as close as possible in meaning and purpose to the invalid provision.
